NHIF to allow men to cover multiple wives for Sh500 The National Hospital Insurance Fund (NHIF) has published regulations that will allow men to get medical cover for multiple wives, if Parliament approves the proposed law, marking a departure from medical insurance norms. The regulations have a clause providing medical coverage to polygamous families on condition the male member pays an extra Sh500 for the additional wives. This is a departure from the current NHIF rules that cover one spouse and a maximum of five children. Most private insurance firms recognise the principal member, one registered spouse and up to four children for medical cover, especially those backed by employers. Members with two wives are often forced to have another cover for the second wife who is listed as the principal member. The NHIFs move to recognise multiple wives comes more than eight years after former President Uhuru Kenyatta signed into law a marriage Bill legalising polygamy. #NHIF

BREAKING NEWS The Kenya Film Classification Board (KFCB) has declared all films containing LGBTQ+ content illegal in Kenya. Section 165 of the Penal Code outlaws homosexuality, adding that any films or broadcast content appearing to legalize, advocate, normalize or glorify the act contravenes the laws and is, therefore, unacceptable as well as demeaning to Christianity as two gay men in the film purport to conduct a religious marriage invoking the name of the Father, the Son and the Holy Spirit. According to Wambua, the film was produced with funding from several foreign organizations. KENYAN LAW According to section 29 of the Constitution of Kenya, female workers are entitled to fully paid three months’ maternity leave. Additionally, maternity leave does not take away the employee s entitlement to annual leave under section 28. Section 5(3) (a) of the constitution protects female employees from harassment and discrimination by the employee on the basis of being pregnant. The law also entitles a male employee to a two weeks paternity leaves with full pay. While many employees in private and government institutions get maternity benefits from their employers, a huge percentage of women especially in the informal sector do not enjoy these benefits as required by the constitution. Lastly, as an employee, get information about your rights to maternity leave and your employer s policies regarding the same. #ParentalLeave

The Central Bank of Kenya(CBK) has directed unregulated digital lenders to cease operations in the country following the lapse of the 6-month registration period that required them to comply with the Digital Credit Providers regulations. Under the said regulations, all digital lenders were expected to apply for licenses from the banking regulator on or before September 17, 2022. So far, the Central Bank of Kenya has licensed 10 applicants as digital credit providers, pursuant to the CBK Act and the Regulations. These include Ceres Tech Limited, Getcash Capital Limited, Giando Africa Limited, Jijenge Credit Limited, Kweli Smart Solutions Limited, Mwanzo Credit Limited, MyWagepay Limited, Rewot Ciro Limited, Sevi Innovation Limited and Sokohela Limited. Other applicants are at different stages in this process, largely awaiting the submission of requisite documentation. The Code specifies the number of methods to combat Disinformation. The major social media platforms have apparently adopted it. I wonder whether some might think that some bits of the Fox News or CNN websites might sometimes be considered "Disinformation" as defined above.

Information influence operation refers to coordinated efforts by either domestic or foreign actors to influence a target audience using a range of deceptive means, including suppressing independent information sources in combination with disinformation. Foreign interference in the information space often carried out as part of a broader hybrid operation, can be understood as coercive and deceptive efforts to disrupt the free formation and expression of individuals’ political will by a foreign state actor or its agents. The law is Silent on this, I will advise you allow her decide when to resume within the 3Months Maternity leave days that she had been granted.
If she wants to stay back the whole 3 months well and good, If she will only require one month of it and after that she will be fit to resume then fine as well. Give her the liberty to decide within the time frames granted. It is always important for us HRPs to view employees as Humans first then resources next.

The Law of Succession (Amendment) Act 2021 certain provisions of the Law of Succession Act, 1981 CAP 160 for starters Section 3 by introducing a new definition of the term “spouse.” It defines a spouse to mean a husband or a wife or wives recognized under the Marriage Act, 2014. The Marriage Act under section 6 recognizes 5 types of marriages which are Christian marriage, Civil marriage, Customary marriage, Islamic marriage and Hindu marriage. In these 5 types of marriages; Christian marriage, Civil marriage and Hindu marriage are monogamous in nature while Customary marriage and Islamic marriage are polygamous or potentially polygamous in nature.
Section 29 has also been substituted with a new Section 29 which seeks to define who a dependant is, the new amendment provides that Dependant means- 1.The spouse and children of the deceased whether or not maintained by the deceased immediately prior to his death; and 2.Such of the deceased’s parents, step parents, grandparents, grandchildren, step-children, children whom the deceased had taken into his family as his own, brothers and sisters, as were being maintained by the deceased immediately prior to his death.

After the recent enactment of Companies Act 2015 and Insolvency Act 2015, various regulations and guidelines have been issued with a view to make the implementation of these acts easier and to resolve areas of conflict or uncertainty. A new Income Tax Act is expected to be introduced in 2018, amending the 1974 version and modernising the tax system. Amendments to the Banking Act 2015 (enacted through the Banking (Amendment) Act 2016), capped the rate of interest chargeable by banks, and has significantly tightened credit and liquidity in the country (particularly for the SME sector). According to a recent analysis by Cytonn Investments, access to credit in the private sector is at an eight-year low of 2.1% (in May 2017) compared to 25.8% at its peak in June 2014 (https://www.cytonn.com/topicals/topical-july-23-2017).

How many days notice should I be given before EVICTION?
Landlords usually exert unreasonable control over tenants with regards to payment of rent, increasing the rent, and evictions. The main reason is that the tenants do not know their rights. I’ll also like to know something about tenant law….
First, for a tenant who’s on a long-term registered lease, the lease terms will operate. A lease provides the lessee security of tenure for the entire period until the lease period is expired. For instance, if you were paying rent on a monthly basis, the Landlord should give a one month’s termination notice. Upon the lapse of the termination notice, the Tenant becomes a trespasser. The Landlord can apply to the Environment and Land Court for an eviction order. The Court of Appeal in Gusii Mwalimu Investment Co. Ltd & 2 others vs. Mwalimu Hotel Kisii Ltd, Civil Appeal No. 160 of 1995 applied by the High Court in Teresia Irungu vs. Jackton Ocharo & 2 others [2013] eKLR, held that: “It is trite law that unless the tenant consents or agrees to give up possession the landlord has to obtain an order of a competent court or a statutory tribunal (as appropriate) to obtain an order for possession.” 2. There are different types of eviction in Kenya: - a. Eviction of a Tenant at a residential unit; b. Eviction of a Tenant from business premises protected under Cap 301; and c. Eviction of unlawful/illegal settlers. By first knowing where you fall within these categories, then you’ll know how to defend your rights on the same.
